1. Agreement to Terms

By accessing or using ChomokAI (referred to as "the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you are prohibited from using the Service.

3. User Accounts & Security

To use most features of the Service, you must register for an account using our authentication provider (Clerk). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscriptions, Credits, & Payments

• Credits: Our Service operates on a credit system for generating AI concepts and AI images. Credits are consumed upon successful generation requests.
• Billing Cycles: Subscriptions are billed on a recurring monthly or yearly basis through Paddle. You can cancel your subscription at any time.
• Taxes: All payments are subject to local taxes (such as VAT or Sales Tax) as calculated and collected by Paddle.com based on your billing region.

5. Intellectual Property & License

ChomokAI grants you a non-exclusive, non-transferable, revocable license to access and use the Service. You retain all ownership rights to the creative outputs (thumbnails, ad layouts, and images) generated using your account, subject to your compliance with these Terms. You must not resell the core AI software platform or reverse engineer our API systems.

6. Acceptable Use Policy

You agree not to use the Service to generate content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of another's privacy.
• Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Contains software viruses or any code designed to disrupt, damage, or limit the functionality of the Service.
• Violates the terms of service of our underlying AI provider APIs (such as Google Gemini).

7. Limitation of Liability

To the maximum extent permitted by applicable law, ChomokAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. We will provide notice of any material changes by posting the updated terms on this page. Your continued use of the Service after any changes constitutes acceptance of the new terms.
